POLICIES

  • ZEM wishes to maintain a balance of leads and follows during its activities to provide a better experience for all. When you purchase a ticket for an activity, you are expected to select the ticket that reflects the role you primarily intend to dance. You are allowed to chose a different role depending on the activities (e.g., lead for a given workshop and follow for another one). However, we expect you to participate in activities that match your skill level accordingly. If there are no tickets left for the desired role, we expect you to join our waitlist.

    If we find that you were not honest in selecting your role, we may deny you access to our activities.

  • ZEM expects participants to select the ticket that best reflects their level of proficiency. We strive to maintain a balanced schedule that is beneficial to dancers of all levels, with content that is relevant and achievable for them to evolve at each stage of their growth. We need your help and cooperation to make this a success.

    Level-rated workshops are not meant to penalize or make participants feel like they aren’t “good enough”. On the contrary, they are designed to give participants material that is accessible and can actually be put into practice. This way, everyone has a better learning experience.

    If you are not sure of your level, contact Josiane or Sébastien at info@zemontreal.com. We will be able to tell you what competencies are required for each level.

  • ZEM does not allow drugs or alcohol on our sites or in adjacent parking lots (except in cases where we explicitly state that we have a permit for alcohol consumption on site only). Any drugs or alcohol will be confiscated on the premises if found, or you will be asked to leave and not return with these items.

    Note that Quebec laws prohibit the use of alcohol and drugs in public spaces (we encourage you to review the rules currently in force as they can change overtime). You can also be arrested for impaired driving if you drink inside a vehicle and have access to its keys, even if your blood alcohol level is not over the legal limit. This is not our policy – it is the law.

    While marijuana is now legal, we do not allow its use on the premises of our activities. As a reminder, Quebec law strictly prohibits driving under the influence of marijuana or other drugs.

    It is forbidden to sell drugs, including marijuana, on the premises of our activities. No illegal substances of any kind are permitted. If you are found in possession of these substances, you will be banned from the premises without a refund. ZEM reserves the right to dismiss any person who, in our opinion, is too intoxicated to participate responsibly in our activities.

  • ZEM strives to provide welcoming premises that promote learning. We wish to maintain a good relationship with each of the landowners so that we can continue to have access to their installations. As such, we expect you to respect the following rules:

    • Refillable bottles and outside food and beverages are not allowed, except in group classes and if we explicitly state otherwise. Workshops provided during socials are not group classes.

    • Use dance shoes or indoor shoes. No outdoor shoes are allowed on the dance floors.

    • We ask that you please throw out garbage responsibly and clean up after yourself.

    Failure to comply with these regulations may result in you being asked to leave or denied access to the premises.

  • All vendors who wish to sell goods or services publicly or wish to have a table to sell their merchandise must obtain an authorization from ZEM by contacting us at info@zemontreal.com. It is your responsibility to provide proof of insurance to ZEM, staff your booth, and ensure you comply with provincial regulations regarding your goods and services.

    Instructors may sell merchandise (e.g., t-shirts, DVDs) at the end of their workshops but they must still obtain an authorization from ZEM beforehand.

TICKET PURCHASE, CHANGE, REFUND AND TRANSFER POLICY

  • All purchases must be completed BEFORE the start of the activity (class or event), except on the advice of the instructor (e.g., if the course has already started when you want to make the payment).

    Types of payment accepted

    Online: PayPal

    In person: cash, Interac or credit card

  • Regular classes or events

    Any change request sent to ZEM within 48 hours of the purchase of your class or ticket will be accepted free of charge. Thereafter, an administrative fee of $10 will apply. A transfer to another individual (even within 48 hours) is not considered a change, and the Transfers policy will apply.

  • REGULAR CLASSES

    Cancellation before the start of the 1st class

    There is no fee if you cancel your registration before the start of the 1st class. If an amount has already been paid, it will be refunded to you in full (via the same payment method) if it is claimed within 30 days of the date of purchase. This amount is not transferable but can be credited, at your request, for use at a later date.

    Cancellation after the 1st class

    If the session has started, past classes are non-refundable. For the remaining classes, a penalty of 10% of the price of the remaining classes will apply, except when a credit is issued.

    Refunds will be processed via the same method of payment within 10 days of notification of cancellation. The amount to be refunded is not transferable but may be credited, at your request, for use at a later date.

    *Note: this refund policy only applies to the cancellation of a purchased group class session. Any missed class during the session will not be refunded or credited. If you are unable to attend the full session due to personal planned activities, you can contact ZEM before the start of the session.

    EVENTS

    All tickets for our events are NOT refundable. In the event that an artist is unable to attend the event due to unforeseen circumstances, ZEM will offer an alternative program for the planned event.

    In exceptional cases, ZEM may, at its discretion, decide to offer:

    • to apply the price of the ticket to the price of the ticket of a future event

    • a credit offset for our regular activities

    ZEM reserves the right to reimburse a participant if they do not meet the required criteria for the purchase of a given ticket (e.g., a beginner participant purchasing an advanced-level pass).

  • EVENTS

    Tickets for an event can be transferred to another person in the same role (e.g., lead or follow) by contacting info@zemontreal.com no later than 48 hours before the event. A $15 fee will apply. A transfer is only confirmed when you receive written confirmation from the organizer.

    No attendee may sell a ticket for more than the price paid. Making a profit on resale is strictly forbidden and will result in a permanent ban from participating in our events at the organizers’ discretion. Potential buyers are encouraged to contact ZEM directly to ensure the legitimacy and price of the ticket.

    If the purchase is made in a group, there is no charge for transfers within the group’s geographical limits. Otherwise, the fee will be $15 PLUS the recuperation of the group discount on that ticket (e.g., if each participant received a $20 discount on the ticket, the transfer fee will be $35).

ASSIGNMENT OF IMAGE RIGTHS

  • By participating in our activities (regular classes or events), you agree that your face or likeness may appear in photos or videos shared on our website and/or social media (Facebook, Instagram, etc), and that your image may be used for promotional, marketing or digital content purposes (e.g., on our website, on other sites mentioning ZEM, or in the online albums created for our activities).

    You consent to being photographed or videotaped by our media team while in any location related to our activities, including pre-party and after-party venues, event hotels and other venues (indoor or outdoor) associated with our activities.

    You hold no rights to the photographs, videos, or other representations of you (collectively or individually referred to hereinafter as "image") produced by ZEM's media team, its volunteers, collaborators or participants. You may use the image for personal use only, in compliance with any directions for use indicated by ZEM or the photographer/videographer.

  • If you are identifiable in a photo or video used, you can request its removal. ZEM will remove any image from online albums that you are not comfortable with within 48 hours of request acknowledgement.

    In the case of promotional or design materials (e.g., event promotional posters, digital graphics, website design, etc.), ZEM may decide to continue using your image, only in the rare cases where it is not feasible (at ZEM’s sole discretion) to change the image due to the time and resources required.

  • You can take photos and videos during all our activities unless otherwise stated by ZEM, or where the subject or event specifically requests that no videos or photos be taken (e.g., if a troupe requests that their performance not be filmed).

    It is not permitted to take photos or videos of individuals not related to our activities (e.g., employees of the venue or hotel, etc.) without their express verbal or written permission.

    ZEM will seek permission prior to sharing or using privately acquired photographs or videos, but retains the right to re-share or embed any photos or videos publicly posted on social media without specific consent.

  • Remember that not everyone likes to have their picture or video taken and/or posted. You are responsible for ensuring that the subject of your non-official photo or video consents to appear in it (e.g., you should ask dancers before (or immediately after) filming in social situations if they consent to your photo or video being published). You must not publish photos or videos without the subject's consent. If someone asks you to remove a photo or video of them, you must do so as soon as possible.

    You can only film portions of the workshops with the instructor's consent. Most instructors will offer a summary at the end of the class or workshop specifically for this purpose. Be aware that workshops and teaching are how professionals make a living, and that this is not a free online course. These are courses for participants with a desire to learn. Any video that shows the instructor teaching must not be posted publicly online or otherwise share, and must be used in accordance with fair dealing legislation (e.g., you can share a video privately with a training partner, but cannot put it online for your entire community to learn from).

ACCIDENTS WAIVER OF LIABILITY

By participating in any of ZEM’s activities (including but not limited to classes, workshops, and special events), you agree to the following conditions:

YOU ASSUME ALL RISKS OF PARTICIPATING IN ANY OF ZEM’S ACTIVITIES. This includes, but is not limited to, personal injuries that occur while participating in performances, social dances or workshops, or while walking to or from the site of the activities. You also assume any risks that may arise from negligence or carelessness on the part of ZEM and their affiliates, volunteers, sponsors, employees, artists, and/or their directors, officers, representatives and agents, or any other related entity not explicitly mentioned (hereafter, the “Released Parties”), and any venue where ZEM carries on its activities. This includes but is not limited to any risks arising from dangerous or defective equipment or property owned, maintained or controlled by the Released Parties. You will assume any risks for which the Released Parties would be liable, without fault.

Risks include, but are not limited to, those caused by the terrain, facilities, temperature, weather, physical or mental condition of participants, equipment, vehicular traffic, lack of hydration and the actions of others, including, but not limited to, participants, volunteers, instructors and/or producers of the activity. These risks are not only inherent to participants, but also present for volunteers and any other party. 

YOU ACKNOWLEDGE that ZEM's activities involve strenuous physical and mental components, which can result in death, serious injury or loss of property.

YOU CERTIFY that you are physically fit to participate in ZEM’s activities and that (if necessary), you have sufficiently prepared or trained to participate in the desired activities. You certify that there are no health-related reasons that prevent you from participating in the activities. You understand that you should not participate in ZEM’s activities if you have been advised by a qualified medical professional not to do so. If a qualified medical professional has advised you not to participate in any aspect of ZEM's activities, you assume full responsibility for any problems that may arise from your participation.

YOU UNDERSTAND that it is your responsibility to manage your participation in ZEM's activities, including (by way of example, but not limited to) making it known if you are uncomfortable or unable to perform any movements for any reason whatsoever (including both mental and physical reasons). You understand that you have the right to refuse to participate in any aspect of the activities and that it is entirely your responsibility to decide whether or not to participate. You assume all risks in this regard.

YOU UNDERSTAND that the laws of Quebec, Canada govern this waiver. In the event of a dispute, this waiver will be interpreted under and in accordance with the laws of the province of Quebec and those of Canada applicable therein.

YOU UNDERSTAND that if any provision or part of this waiver is found to be invalid or unenforceable, in whole or in part, such invalidity or unenforceability will affect only that portion of this waiver that is invalid or unenforceable, and that the remaining parts of this waiver will remain in full force and effect.

YOU ACKNOWLEDGE that the Released Parties will rely on this Accidents Waiver of Liability, and that it will govern your actions and responsibilities at ZEM with respect to your participation in any and all activities. This Accidents Waiver of Liability shall be construed broadly to provide a release and waiver to the maximum extent permitted by Quebec law.

On behalf of yourself, your executors, administrators, heirs, next of kin, successors and assigns, you swear the following: 

(A) I WAIVE, RELEASE AND DISCHARGE the Released Parties from any and all liability, including but not limited to, liability arising from the negligence or fault of the Released Parties, for my death, disability, personal injury, property damage, property theft, or actions of any kind that may befall me hereafter, including my travel to and from such activities.

(B) I INDEMNIFY, HOLD HARMLESS, AND AGREE NOT TO SUE the Released Parties from any and all claims, damages, losses and actions, including reasonable legal fees, resulting from damages or liability for personal injury, including death, or property damage, caused by a negligent act, strict liability, breach of contract, error or omission of the Released Parties or any of their agents, subcontractors or employees for any event or activity related to ZEM.

(C) I consent to receive such medical treatment as may be deemed advisable in the event of injury, accident and/or illness during these activities, and that if I reject any advisable medical treatment, I am solely responsible for any results and all liability for that decision.

(D) I CERTIFY THAT I HAVE READ THIS DOCUMENT AND FULLY UNDERSTAND ITS CONTENT. I AM AWARE THAT THIS IS A RELEASE OF LIABILITY AND A CONTRACT AND I SIGN IT DIGITALLY OF MY OWN FREE WILL. I UNDERSTAND THAT I HAD THE OPPORTUNITY TO SEEK CLARIFICATION FROM ZEM OR MY OWN INDEPENDENT LEGAL COUNSEL.
